WARE — Healthwise Foundation Inc. has withdrawn its attempt to open a medical marijuana dispensary in town.
An attorney with the company, James McMahon, canceled a scheduled appearance at a public hearing with Ware select board members Tuesday night, according to town officials. Officials said the lawyer told them there was too much community opposition to the idea.
McMahon was seeking a letter of “non-opposition” from selectmen, a document he planned to provide to the state Department of Public Health as part of the permitting process.
Healthwise Foundation said they wanted to locate the dispensary at 39-41 West Main St.
Ware Board of Health, in a recent letter to selectmen, advised them that the proposed location conflicted with state guidelines that say a dispensary cannot be within 500 feet of a daycare center, and that the proposed location was within the prohibited zone.
Telephone messages placed to McMahon have not been returned.
The company was seeking to open a medical marijuana site, and, down the road, planned to sell recreational marijuana, according to Ware Town Manager Stuart Beckley.
McMahon’s decision to halt the company’s plans in town were communicated via a telephone conversation, the manager said.
