Upper Darby OKs site for proposed cannabis dispensary – The Delaware County Daily Times

UPPER DARBY >> Township zoners have given the green light to a proposed medical marijuana dispensary in the only place permitted in the township, a C-4 Commercial Industrial District, in the Fernwood section.

Zoners granted approval to Chamounix Ventures Inc. to set up shop at 622 Industrial Park Drive.

While the applicant has received approval to locate in Upper Darby, the state has not granted any licenses to open a dispensary and is in the process of accepting applications.

Councilman Jacob Bierling, who recently introduced and approved an ordinance to restrict a medical marijuana dispensary, announced his intention to amend the ordinance in accordance with state regulations that would permit the facility in the industrial sector.


“I will stipulate factually there is no opposition from the township” to opening the dispensary in the industrial park, Bierling said.

No one in attendance at the zoning hearing opposed the application.

Carl W. Ewald of Media informed zoners of a meeting with council members Selela Coles and Bierling.

The application is in Coles’ 7th District and Bierling is chairman of the Planning, Zoning and Building Code Committee.

“There is no place in the entire township where we could put in this use,” Ewald said if Bierling doesn’t amend the ordinance. “We are challenging the validity and asking the board to grant the variance.”

M. Louis van de Beek, M.D., and Michael Joseph, speaking in behalf of Chamounix, addressed council at the hearing and opposed adoption of the ordinance.

According to Joseph, the dispensary operates exactly like a pharmacy where a patient would receive a prescription and go home.

“We mapped every institutional use in the township,” Joseph said noting that the facility is not near a school, pre-school, school bus stop, church school or pre-kindergarten center. “We are more than 250 feet
